Synopsis
The first ever industrial revolution started in world, made labor and raw materials the key issues of its development. In the same way, the technology-led information and knowledge-based economic world is now centering its whole intellectuality on Intellectual property, which is a generic term that refers to intangible objects like copyrights, patent etc. In the new world economy of knowledge, ideas, access to creative works, ownership, scientific knowledge and control have tremendous economic impact and increased competition on the so-called knowledge wars. But the recent attempt made by the scholars and policy-makers at the international level to relate this knowledge-based rights to the human rights framework is noteworthy. In an international initiative, the United Nations Sub-Commission on the Promotion and Protection of Human Rights, adopted a resolution addressing this topic at its August, 2000, session. It declares that: “Since the implementation of the TRIPS Agreement does not adequately reflect the Fundamental nature and indivisibility of all human rights… There are apparent conflicts between the intellectual property rights regime embodied in the TRIPS Agreement, on the one hand, and international human-rights law, on the other.†Hence, this book discusses the aspect that the policy-makers must meet the challenges making human rights framework of intellectual property positive and constructive dialogues should be there to bring the intersection. The success of this framework will not only help individuals achieve their protection of moral and material interests in intellectual creations, but also provide a mechanism to harness the intellectual property system to the states to protect human dignity and to promote full realization of human rights.
